    These Terms & Conditions (“Agreement”) govern the website, estimates, proposals, contracts, communications, construction services, remodeling services, and related services provided by Builders For You LLC, located in Yuma, Arizona.

    Builders For You LLC may be referred to throughout this Agreement as “Builders For You,” “Contractor,” “Company,” “we,” “our,” or “us.” The customer, property owner, website visitor, authorized representative, or person requesting services may be referred to as the “Client,” “Customer,” “you,” or “your.”

    By visiting our website, submitting a form, requesting an estimate, approving a proposal, signing a contract, making a payment or deposit, opting into communications, or authorizing work to begin, you acknowledge that you have read, understood, and agreed to these Terms & Conditions.

    Builders For You LLC provides construction, remodeling, renovation, repair, project management, and related property improvement services for residential and commercial customers.

    Any applicable contractor license information may be included in the Client’s proposal, construction contract, invoice, work authorization, or other project-specific document.

    2. Scope of Work

    Builders For You agrees to provide the labor, services, supervision, materials, equipment, subcontractor coordination, or project management described in the approved estimate, proposal, invoice, work authorization, change order, or written construction contract.

    Services may include, but are not limited to:

    • Ground-up residential construction
    • Ground-up commercial construction
    • Custom home construction
    • New construction
    • Residential remodeling
    • Commercial remodeling
    • Kitchen remodeling
    • Bathroom remodeling
    • Shower renovations
    • Home additions
    • Home renovations
    • Hotel renovations
    • Demolition
    • Flooring installation
    • Interior painting
    • Exterior painting
    • Drywall installation and repair
    • Cabinet, countertop, sink, and fixture installation
    • Furniture assembly
    • Exterior renovations
    • General property repairs and improvements
    • Construction consulting
    • Project planning
    • Project coordination
    • Project management

    The exact scope of work will be stated in the applicable written project document. Any service, material, repair, upgrade, or task not specifically included in the written scope of work is excluded unless approved through a written change order.

    Builders For You does not guarantee that every listed service is available for every project or location. Service availability may depend on project size, licensing requirements, subcontractor availability, permit requirements, scheduling, and site conditions.

    3. Estimates and Pricing

    Estimates and proposals are based on the information, measurements, photographs, plans, site conditions, material pricing, labor pricing, and project requirements known at the time the estimate is prepared.

    Unless otherwise stated in writing, estimates are valid for sixty calendar days from the date issued.

    Pricing may be modified before or during the project because of:

    • Changes to the scope of work
    • Customer-requested upgrades or additions
    • Changes in material, supplier, fuel, equipment, or labor costs
    • Inaccurate measurements or information supplied by the Client
    • Hidden or unforeseen conditions
    • Structural damage
    • Water damage
    • Mold, rot, or termite damage
    • Plumbing or electrical problems
    • Code violations
    • Engineering requirements
    • Permit or inspection requirements
    • Soil, grading, drainage, or foundation conditions
    • Hazardous or regulated materials
    • Supplier shortages
    • Discontinued or unavailable materials
    • Errors or omissions in plans supplied by the Client or a third party

    An estimate is not a guaranteed final price unless it is expressly identified as a fixed-price agreement in a signed written contract.

    Website prices, advertisements, general price ranges, verbal estimates, text messages, social media posts, and promotional offers are not final contractual pricing.

    4. Deposits and Payment Terms

    A deposit may be required before Builders For You schedules work, orders materials, secures subcontractors, obtains permits, prepares plans, or begins a project.

    The payment schedule will be stated in the applicable proposal, invoice, work authorization, or contract. Payments may include:

    • Initial deposit
    • Material payment
    • Progress payments
    • Milestone payments
    • Change-order payments
    • Final payment upon substantial completion

    The Client agrees to make all payments by the deadlines stated in the project documents.

    Builders For You may suspend scheduling, material ordering, permit processing, subcontractor work, warranty service, or project performance when payments are not made as agreed.

    Late or unpaid amounts may be subject to:

    • Late charges
    • Interest
    • Returned-payment fees
    • Chargeback fees
    • Collection costs
    • Attorney fees
    • Court costs
    • Arbitration costs
    • Mechanic’s lien rights
    • Other remedies permitted under Arizona law

    The Client agrees not to initiate a chargeback or payment dispute for properly authorized work without first providing Builders For You a reasonable opportunity to investigate and resolve the issue.

    Final payment is due when the project reaches substantial completion unless the written contract states otherwise. Minor punch-list items that do not prevent reasonable use of the completed work do not justify withholding the full unpaid balance.

    5. Scheduling and Delays

    Project start dates and completion dates are estimates unless expressly guaranteed in a signed written contract.

    Builders For You will make reasonable efforts to complete work according to the estimated schedule. However, the Client understands that construction and remodeling projects may be delayed by circumstances including:

    • Weather
    • Extreme heat
    • Rain, wind, flooding, or storms
    • Material shortages
    • Supplier delays
    • Equipment failure
    • Labor shortages
    • Subcontractor delays
    • Permit processing
    • Inspection scheduling
    • Utility company delays
    • Engineering or architectural revisions
    • Change orders
    • Hidden conditions
    • Customer decisions
    • Customer payment delays
    • Inaccessible work areas
    • Unsafe site conditions
    • Emergencies
    • Government actions
    • Events outside the reasonable control of Builders For You

    Builders For You is not responsible for losses, temporary housing costs, lost income, business interruption, storage costs, financing costs, or other damages caused by delays outside its reasonable control.

    Any delay caused by the Client may result in additional labor, mobilization, storage, travel, material, or scheduling charges.

    6. Client Responsibilities

    Before and during the project, the Client agrees to:

    • Provide complete and accurate project information
    • Confirm ownership of the property or authority to approve the work
    • Provide reasonable and timely access to the property
    • Provide working water and electricity when required
    • Remove or protect furniture, vehicles, decorations, equipment, and personal belongings
    • Keep children, pets, tenants, guests, and unauthorized persons away from work areas
    • Provide timely selections of colors, materials, fixtures, finishes, and layouts
    • Review and approve project documents promptly
    • Make payments according to the agreed schedule
    • Disclose known defects, hazards, leaks, damage, or prior repairs
    • Provide accurate plans, measurements, surveys, or reports when applicable
    • Obtain HOA, landlord, property management, or lender approval when required
    • Avoid interfering with employees, subcontractors, or installation procedures
    • Notify Builders For You promptly of any concern
    • Maintain appropriate property insurance
    • Protect completed work from damage after installation

    The Client is responsible for delays and additional costs caused by failure to meet these responsibilities.

    Unless otherwise agreed in writing, Builders For You is not responsible for moving, storing, or protecting valuable, fragile, irreplaceable, or personal items.

    7. Existing Conditions, Hidden Conditions, and Limitations

    Construction, demolition, repair, and remodeling work may expose hidden conditions that were not visible or reasonably discoverable before work began.

    Hidden conditions may include:

    • Water intrusion
    • Mold
    • Rot
    • Termite or pest damage
    • Asbestos
    • Lead-based paint
    • Structural defects
    • Foundation movement
    • Soil problems
    • Drainage issues
    • Plumbing leaks
    • Electrical hazards
    • Gas-line problems
    • Improper framing
    • Improper previous repairs
    • Code violations
    • Unpermitted work
    • Damaged roofing components
    • Underground utilities
    • Inadequate insulation
    • Unsafe materials
    • Defective customer-supplied products

    Builders For You is not responsible for preexisting conditions or damage caused by previous contractors, property movement, improper maintenance, defective construction, water intrusion, pests, age, normal deterioration, or conditions outside the approved scope of work.

    Additional labor, materials, testing, remediation, engineering, permits, or repairs required because of hidden conditions will be treated as additional work and may require a change order.

    Builders For You may stop work if a hidden condition creates a safety concern or materially changes the project requirements.

    8. Change Orders

    Any modification to the approved scope of work may require a written change order.

    Change orders may be required for:

    • Additional work requested by the Client
    • Material or design upgrades
    • Changes in colors, finishes, layouts, or fixtures
    • Hidden damage
    • Code-required work
    • Engineering or inspection requirements
    • Repairs excluded from the original scope
    • Customer-supplied material issues
    • Changes requested after work has begun
    • Additional mobilization or remobilization
    • Delays caused by the Client or third parties

    A change order may modify the total price, payment schedule, estimated completion date, warranty, materials, or project sequence.

    Verbal instructions are not binding unless Builders For You confirms them in writing.

    The Client agrees to pay for authorized change-order work according to the payment terms stated in the change order. Builders For You may require payment before beginning the additional work.

    9. Warranty

    Any workmanship warranty offered by Builders For You will be stated in the applicable written proposal, contract, invoice, or separate warranty document.

    Unless a specific warranty is stated in writing, no additional express warranty is provided.

    Warranty coverage is limited to defects directly caused by Builders For You’s workmanship under normal use and conditions.

    Warranty coverage does not include:

    • Normal wear and tear
    • Cosmetic variations
    • Material color or texture variation
    • Customer misuse
    • Abuse or neglect
    • Failure to perform required maintenance
    • Water leaks or water intrusion
    • Flooding
    • Mold
    • Termite or pest damage
    • Structural movement
    • Foundation movement
    • Soil movement
    • Cracking caused by building movement
    • Weather or natural disasters
    • Damage caused by third parties
    • Customer modifications
    • Work performed by another contractor
    • Defective customer-supplied materials
    • Manufacturer defects
    • Damage caused by plumbing, electrical, roofing, HVAC, or other systems outside the scope of work
    • Damage caused by failure to follow care instructions
    • Damage occurring after the completed work has been accepted

    Manufacturer warranties are provided by the applicable manufacturer and are subject to the manufacturer’s terms, exclusions, and claim procedures. Builders For You does not control manufacturer warranty approvals or processing times.

    The Client must report a suspected warranty issue in writing within a reasonable period after discovery and provide Builders For You an opportunity to inspect the issue before repairs are performed by another party.

    Unauthorized repairs may void warranty coverage.

    10. Cancellation and Termination

    Cancellation terms may be included in the project-specific proposal or contract.

    If the Client cancels after approving a project, Builders For You may retain or deduct amounts reasonably associated with:

    • Administrative work
    • Planning
    • Design
    • Measurements
    • Permit processing
    • Material orders
    • Custom materials
    • Restocking fees
    • Supplier charges
    • Subcontractor commitments
    • Labor scheduling
    • Travel
    • Mobilization
    • Work already completed
    • Other nonrecoverable project expenses

    Deposits may be nonrefundable once materials have been ordered, labor has been scheduled, permits have been processed, or work has begun.

    If the Client cancels shortly before the scheduled start date, the Client may be responsible for scheduling, labor, travel, mobilization, equipment, supplier, and administrative costs already incurred.

    Builders For You may terminate or suspend the project because of non-payment, unsafe conditions, Client interference, material misrepresentation, abusive conduct, denied access, permit issues, or a material breach of the agreement.

    11. Right to Refuse or Suspend Work

    Builders For You reserves the right to refuse, delay, suspend, or discontinue work when:

    • Payments are overdue
    • Unsafe conditions exist
    • Required permits or approvals are unavailable
    • The Client interferes with construction procedures
    • The Client or another person engages in threatening, abusive, discriminatory, or unlawful conduct
    • Site conditions differ materially from the original inspection
    • Hazardous or regulated materials are discovered
    • Weather or environmental conditions make work unsafe
    • The Client denies reasonable access
    • Customer-supplied materials are defective, unavailable, or unsuitable
    • Continuing the work may violate applicable law, building codes, manufacturer requirements, or professional standards

    A suspension caused by the Client may result in additional costs and schedule changes.

    Builders For You is not responsible for damage or deterioration resulting from a Client’s failure to authorize necessary protective or corrective work after a project is suspended.

    12. Cleanup, Completion, and Final Inspection

    Builders For You will perform reasonable cleanup of construction debris directly created by its work, unless the written scope states otherwise.

    Reasonable cleanup does not include professional deep cleaning, removal of unrelated debris, hazardous material removal, cleaning of unaffected areas, landscaping restoration, or disposal of customer-owned materials unless specifically included.

    The Client agrees to participate in a final walkthrough or inspection when requested.

    The project will be considered substantially complete when the work can reasonably be used for its intended purpose, even if minor corrective or punch-list items remain.

    The Client must provide written notice of visible concerns within fourteen calendar days after substantial completion. Failure to provide written notice within this period may be treated as acceptance of the visible work, except for valid warranty claims or rights that cannot legally be waived.

    Punch-list items do not authorize the Client to withhold payment beyond the reasonable value of the incomplete item unless the contract states otherwise.

    13. Limitation of Liability

    To the fullest extent permitted by Arizona law, Builders For You LLC and its owners, employees, subcontractors, representatives, and affiliates will not be liable for indirect, incidental, special, punitive, exemplary, or consequential damages.

    This limitation includes claims involving:

    • Lost profits
    • Lost revenue
    • Business interruption
    • Loss of use
    • Temporary relocation expenses
    • Financing costs
    • Emotional distress
    • Loss of property value
    • Damage unrelated to Builders For You’s proven negligence
    • Delays outside Builders For You’s reasonable control

    To the fullest extent permitted by law, Builders For You’s total liability arising from a specific project will not exceed the amount actually paid to Builders For You for the portion of work directly giving rise to the claim.

    Nothing in these Terms limits liability that cannot legally be limited under applicable law.

    14. Indemnification

    The Client agrees to defend, indemnify, and hold harmless Builders For You LLC, its owners, employees, subcontractors, representatives, and affiliates from claims, losses, damages, liabilities, costs, and expenses arising from:

    • Unsafe property conditions
    • The Client’s negligence
    • The Client’s violation of these Terms
    • Failure to disclose known defects or hazards
    • Failure to obtain required ownership, HOA, landlord, lender, or third-party approval
    • Inaccurate information provided by the Client
    • Unauthorized use of Builders For You’s website or content
    • Actions of tenants, guests, visitors, pets, or third parties under the Client’s control
    • Customer-supplied plans, materials, products, or instructions
    • Work performed by another contractor
    • Conditions unrelated to Builders For You’s approved scope of work

    This section does not require the Client to indemnify Builders For You for liability caused solely by Builders For You’s proven gross negligence or intentional misconduct where such indemnification is prohibited by law.

    15. Photographs, Reviews, Testimonials, and Marketing

    Builders For You may photograph or record project conditions, work progress, materials, and completed work for:

    • Project documentation
    • Quality control
    • Employee and subcontractor coordination
    • Insurance documentation
    • Training
    • Portfolio use
    • Website content
    • Social media
    • Advertising
    • Promotional materials

    Builders For You will not intentionally publish sensitive personal information, access codes, financial information, or private documents.

    The Client may submit a written request that completed-project photographs not be used publicly. Builders For You will make reasonable efforts to honor requests received before publication.

    If the Client voluntarily submits a review, testimonial, photo, video, or feedback, the Client grants Builders For You permission to reproduce, edit, display, and use that content for legitimate business and marketing purposes unless the Client withdraws permission in writing.

    16. SMS Messaging Terms and Compliance

    Builders For You LLC may use SMS and MMS text messaging to communicate with customers regarding estimates, appointments, projects, payments, customer service, and promotional offers.

    By voluntarily providing your mobile telephone number and opting into text communications through our website, online forms, estimate requests, written forms, or other consent process, you agree to these SMS terms.

    Program Description

    Messages may include:

    • Estimate confirmations
    • Appointment reminders
    • Scheduling updates
    • Project status updates
    • Service notifications
    • Change-order notifications
    • Payment and invoice reminders
    • Customer support responses

    Consent to receive marketing messages is not a condition of purchasing goods or services.

    You represent that you are the authorized user of the telephone number provided and agree to notify Builders For You if the number is reassigned or no longer belongs to you.

    Opt-Out Instructions

    STOP, CANCEL, UNSUBSCRIBE, END, or QUIT

    After receiving a valid opt-out request, Builders For You may send one final confirmation message. No additional messages will be sent unless you subsequently opt in again or initiate a new communication request.

    Opting out of marketing messages may not prevent necessary non-marketing communications related to an active project, payment, safety issue, or service request when legally permitted.

    Mobile Privacy and Data Protection

    Builders For You respects the privacy of mobile users.

    Mobile telephone numbers, SMS consent records, text messaging originator opt-in information, and related consent data will not be sold, rented, leased, or shared with third parties or affiliates for their independent marketing or promotional purposes.

    Mobile information may only be disclosed to service providers, communication platforms, telecommunications providers, software vendors, professional advisers, or other parties when reasonably necessary to operate the messaging service, provide requested services, comply with law, prevent fraud, or protect legal rights.

    17. Dispute Resolution

    If a dispute arises, the parties agree to first attempt to resolve it through direct, good-faith communication.

    The Client must provide Builders For You written notice describing the dispute and allow a reasonable opportunity to inspect the work, review relevant documents, and propose a resolution.

    If the dispute is not resolved through direct communication, the parties agree to attempt mediation in Yuma County, Arizona, unless a project-specific written contract states otherwise.

    If mediation is unsuccessful, the dispute may be resolved through binding arbitration in Yuma County, Arizona, under applicable Arizona law and the rules agreed upon by the parties or selected arbitration provider.

    Each party will be responsible for its own attorney fees and costs unless a written contract, arbitrator, court, or applicable law provides otherwise.

    Nothing in this section prevents Builders For You from pursuing collection remedies, mechanic’s lien rights, injunctive relief, or other remedies that must be exercised within a specific legal deadline.

    Project-specific contracts may include additional dispute-resolution requirements that control over this section.

    18. Governing Law

    These Terms & Conditions are governed by and interpreted under the laws of the State of Arizona.

    Any legal proceeding not subject to enforceable arbitration must be filed in a court of competent jurisdiction located in Yuma County, Arizona, unless applicable law requires a different venue.

    19. Force Majeure

    Builders For You is not liable for delays, additional costs, or failure to perform caused by events beyond its reasonable control.

    Such events may include:

    • Natural disasters
    • Severe weather
    • Flooding
    • Fire
    • Extreme heat
    • Earthquakes
    • Epidemics or public health emergencies
    • War
    • Terrorism
    • Civil unrest
    • Government orders
    • Permit or inspection delays
    • Utility interruptions
    • Transportation disruptions
    • Labor shortages
    • Strikes
    • Supplier failures
    • Material shortages
    • Equipment failures
    • Internet or communication outages
    • Acts of God

    Project deadlines will be reasonably extended for the duration and impact of the force majeure event.

    20. Entire Agreement and Conflicting Documents

    These Terms & Conditions, together with any approved estimate, proposal, invoice, work authorization, change order, warranty document, or signed contract, constitute the agreement between Builders For You and the Client.

    If there is a conflict between these Terms and a signed project-specific contract, the signed project-specific contract will control for that project.

    No verbal statement, promise, representation, or modification is binding unless confirmed in writing by an authorized representative of Builders For You.

    Headings are included for convenience and do not limit the interpretation of any section.

    21. Severability and Waiver

    If any provision of these Terms is determined to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect.

    The invalid provision will be interpreted or modified only to the minimum extent necessary to make it enforceable where permitted by law.

    Builders For You’s failure to enforce any provision does not waive its right to enforce that provision later.

    A waiver is valid only when provided in writing by an authorized representative of Builders For You.

    22. Acceptance and Electronic Communications

    The Client accepts these Terms by:

    • Using the Builders For You website
    • Submitting an online form
    • Requesting an estimate
    • Approving a proposal
    • Signing a contract
    • Making a payment or deposit
    • Approving a change order
    • Opting into communications
    • Authorizing work to begin
    • Allowing Builders For You to perform services

    Electronic signatures, checkbox acceptances, email approvals, text-message approvals, online payments, and digital records may be treated as legally binding to the extent permitted by law.

    The Client agrees that Builders For You may provide estimates, invoices, contracts, notices, and project communications electronically.

    The Client is responsible for maintaining accurate contact information and reviewing communications sent to the email address or telephone number provided.

    23. Website Cookies, Privacy, and Data Security

    Cookies and Tracking Technologies

    The Builders For You website may use cookies, analytics tools, pixels, session technologies, and similar tracking methods to:

    • Operate the website
    • Remember user preferences
    • Analyze website traffic
    • Measure advertising performance
